Section 35
<br> to register in Mohiani after receiving Dastur
Before the commencement of this Act, if the land owner wants to register it in Mohiani, if the land owner has registered it in Guthi land before the commencement of this Act, he can register it in Mohiani after taking the receipt as prescribed by the institute.
(2) At the commencement of this Act, if someone has built a house on Guthi land without obtaining the approval of the Corporation, such land may be registered in Mohiani by taking the Dastur as prescribed by the Corporation.
(3) After the commencement of this Act, if anyone requests the permission of the Institute to build a house on Guthi land registered in Mohiani in someone's name or Ailani or barren Guthi land not registered in anyone's name or in the garden of Guthi, the Institute may give approval by taking the fee as prescribed. In this way, if someone builds a house on such land without taking the approval of the institute, the rights of such person to that land and the house built on that land will be terminated and the institute's right will remain. But if the institute feels that there was no bad faith of the person who built such a house before the beginning of this restrictive phrase, the institute can take the approval of the Government of Nepal and take the prescribed additional fee and register it in Mohiani.
(4) Notwithstanding anything written in sub-sections (1), (2) and (3), the approval of the Institute shall not be required to construct a house on Guthi Raitan numbered land.
